In July 2010, a North Carolina district court judge rejected the plaintiff’s claim, and determined that the narrow private club exemption in the state’s smoke-free law was constitutional. Gate City Billiards appealed the decision to the North Carolina Court of Appeals. On July 19, 2011, the court of appeals affirmed the district court’s holding that the law was constitutional. On January 2, 2010, North Carolina’s smoke-free law took effect, prohibiting smoking in nearly all public places, places of employment, and state government vehicles, including for profit clubs.
